Publisher sues Mass. prisons chief over book ban

A publisher that distributes books on the legal rights of prisoners sued the chief of the state's prison system Wednesday, claiming he is banning its publications in Massachusetts prisons.

Prison Legal News, a nonprofit publisher, alleges that Department of Correction Commissioner Harold Clarke and other prison officials refuse to add it to a list of approved vendors who can send books to prisoners.

No standing

I don't see how they can sue, there is no evidence their books have been requested by someone in prison. Had there been a request from an inmate and a denial then perhaps there would be a reason to move forward with litigation.

I have not read the filing, and I don't really have the time to do so, but based upon the article there is no 'victim' and you can't litigate a hypothetical.
